My CPU runs around 40 c most of the times and The my cpu fan runs about 5K But then totally randomly my sytem monitor tool says my spu fan is totally off. I know this isn't true cause i can see it spinning. But it's obviously shuts down cause my cpu temp will shoot up to high 60's-70's and crash. and it takes a while for my cpu fan to get back to opperating speed. WHY?????? Is there a program i can get to change my fan Speed or another way to hook it up? or should i just get another fan and goo From there????

The fan may be failing. It can slow down a little and temps will rise alot.

Regular CPU fans are quite cheap, i would just replace it to save you the hassle of the lock-ups. At least that is what i would do.
