Utah sees first spyware case

Utah recently became the first and only state with spyware legislation, a world's first too. Web-based company Overstock may become the first to make use of the new anti-spyware law when they file a lawsuit against SmartBargains, they allege "that SmartBargains is using spyware to display pop-up ads over the top of Overstock's website. Overstock wants the practise stopped and it wants damages, costs and legal fees".
