RAM timings misadvertised?!! HELP!

  1. CPU-Z and also Everest are reading that my OCZ DDR2-6400 800MHZ CL4 Platinum
    is actually running at cl5? (is that possible?) is the reading misinterpreted ?
    (Since everest reads my ram is XTC memory, which it isn't)..

    right now im going to test to see if Sandra and then PCwizard 2007... but if i see that it runs at cl5.. what can I do about it?
    there are 0 options at my bios for chaning the CL (Motherboard - Gigabyte G965PDS3 rev3.3)

    in almost of all the program I see a chart that says something like
    267MHZCL3
    333MHZCL4
    400MHZCL5

    why do they false advertise then if this is true?)

    EDIT 2:
    ok found a way to enable more options in my bios, now I can change all the RAM settings...
    now my question is, if its advertised at cl4 800mhz, is it safe to do 4-4-4-12 800mhz (instead of the present 5-5-5-15)
    and should I up it by 0.01v? (or more?) or just let the bios automatically increase voltages according to overclocks (it has an Auto option for voltages)...

    edit 3: question that has nothing to do with this^^^
    if up my fsb to 333 and lower my multiplier to 7 (keeping the same exact 2400MHZ) - will that count as overclocking and break my warranty?

    Got my answer, thanks anyway.

    (I needed to open the bios, up the voltages by 0.3 to 2.1V and up the now 5-5-5-15 to 4-4-4-12, and it works perfectly)
