There is no "upgrade version" any more... if you get a Windows 10 license, you have the option of upgrading OR doing a clean install...
Microsoft is basically saying "It's not free... but... there are really easy ways to get it for free...."
If they "officially" make it free, how do you justify selling it to OEM/Enterprise?
But if you also want universal adoption ASAP.... you do what they've done
So while it says "legitimate win7/8 users get a free copy", using their "insider program" gives anyone who wants it a chance to get it free - even if running XP/Vista or whatever...
The "proof" of this is that you'll still be able to join the insider program AFTER Windows 10 has been released!!
