Class-action suit brought against Nintendo over Wiimote

Leaving the realm of personal lawsuits, a class-action suit has been filed against Nintendo for the flaws in the Wiimote's wrist strap. Even though Nintendo has begun a Wiimote recall, a law firm has brought the suit against them to force their hand in issuing refunds and/or replacing the remotes:

The statement from the firm says that Nintendo is in the wrong as owners of the Nintendo Wii who supposedly followed the material that accompanied the Wii console experienced broken wrist strap causing the remote to leave the user’s hand. The lawsuit seeks an injunction that requires Nintendo to correct the defect and to provide a refund to the purchaser or to replace the defective Wii remote.
I fail to see how it is a deceptive business practice as stated in the lawsuit, considering that Nintendo pre-emptively admitted the flaw and is planning to repair the units. It doesn't mention how people who have damaged equipment not related to the Wii will be compensated, if at all. The suit has not yet been approved, so it may still be struck down before it ever sees the light of day.

I NEVER broke the WiiMote and I played all the WiiSports and Call of Duty

    american compensation culture.. lets sue somebody instead of working for their money.. lol wish they'd grow up and accept responsiblity for themselves instead of blaming every1 else..and i agree, it's in your hand so keep hold of the damn remote.. end of problem. and no i haven't let go of my remote either so the strap hasn't even been necessary at all.(i suppose they need straps on their cell phones and tv remotes too just in case they let go of them whilst pressin a button)
