Nintendo sues popular TikTok/Twitch star

The company maybe was afraid that they should have to pay for the damages in her mental health from the use of their products so they “thought” that they must be the first who will sue... :)

To me its pretty stupid to put a multi million company against an individual in a court for what ever reason.

If you really think that something an individual does is unfair or harmful to your multi million company just go and pay him in privet few k and he will stop it for sure.
 
What do you believe they are "getting away with"? A world without trademark protection would be a very sad and sorry place for consumers. When I buy a product with a company name on it, I like knowing it was actually produced by that company, whether it be McDonalds or Mercedes.

As for this particular case, linking a child-friendly mark like Pokémon to the adult film industry can in no way be considered benign. Plus, many people fail to realize that trademark law essentially requires mark owners to police such cases, or risk losing ownership of the mark entirely.

if Nintendo contacted her to inform her prior to "sending Mario", then I have no sympathy with that lady. Otherwise I would blame nintendo.

Well, despite her claim that she was "sued by a giant company", they merely sent her a cease-and-desist letter. This would have been the point that, if she felt she had a case or a counter-claim, to respond before they proceeded with actual legal action.

When I think what people like these days, I am wondering what will become of the human race.
I agree fully on the decision of nintendo, that it porbably damages their brand.

If you (Or whoever) SERIOUSLY believe that a company behind a "murder simulator" should have a need to be legally protected from that lil' thing, adult star or not, because of "image" entanglements, then there is serious problem with the state of the world right now, even beyond the serious problems with the state of the world that we're already sickeningly aware of.

I have no interest in what laws do against libel. I was more like thinking what about using sensitive symbol such as religious figure of a particular group without their permission or using religious symbol in adult entertainment for business. We have seen that is very prevalent among people from particular part of world who defines themselves as champs of free speech.

However, I said it before, I am 100% for all out freedom. "Only" freedom of speech/expression sounds like only 33% of freedom.
So far to my disappointment, it seems freedom only feels safe to operate from secure locations. That doesn't feel very free. After all, no one can deny my freedom of reaction.
