Depends if you intended to the kill the person you were shooting near/at.
Just my 2 cents, haven't seen the video. If it's a cub and wasn't losing altitude fast, any pilot would be looking for a safe landing for as long as possible before bailing.
As for the whole gun debate here (why is it here?) Allow me to simplify: shoot at me, I will shoot you. Point a gun at me, I will shoot you in self defense and fearing for my life (why were you pointing a lethal weapon whose only function is to kill in even my general direction?). Wave a gun at me, I will take cover, fire a warning shot, and stand my ground.
If you own a firearm, please return it immediately, for all our sakes, but especially yours. You should not carry.
