Not a surprise in the slightest, Verizon has struck back at Vonage's request for a retrial. They are urging for the filing to be denied, claiming that what Vonage is asking for is suitable only for appeal, not for a retrial. Vonage wants a retrial based more or less on a technicality, and Verizon is claiming they are too late to the game:
"If there was any error in the jury instructions, Vonage invited the error and should not be heard to complain about it now," Verizon's attorneys wrote in a response motion obtained by CNET News.com.
Vonage's future is on the edge of a razor here, and the outcome of this case will impact VoIP dramatically one way or the other, at least in the U.S.
