Prosecutors charge six Fitbit employees with stealing Jawbone trade secrets

Recap: Jawbone filed a lawsuit against Fitbit in mid-2015 over alleged intellectual property and trade secret theft. Last December, Fitbit announced it had reached a global settlement agreement resolving all outstanding litigation between it and Jawbone.

Federal prosecutors have charged six former and current Fitbit employees with possessing trade secrets stolen from rival wearable products company Jawbone.

The indictment, filed Thursday in federal court in Northern California, notes that each defendant had worked for Jawbone for at least one year between May 2011 and April 2015 before leaving and becoming employed by Fitbit. They had signed a confidentiality agreement with the company, the indictment highlights.

It further claims that each person was aware that the trade secrets had been stolen and that they weren’t supposed to be in possession of them.

Each defendant was charged with one or more counts of possession of trade secrets.

Those indicted are scheduled to appear in court on July 9, 2018. If convicted, they face a maximum sentence of 10 years in jail and a $250,000 fine per count followed by up to three years of supervised release.

A spokesperson for Fitbit offered the following statement to multiple publications:

“In a trade secret misappropriation case brought by Jawbone in the International Trade Commission in 2016 that involved these same individuals, a federal administrative law judge during a nine-day trial on the merits found that no Jawbone trade secrets were misappropriated or used in any Fitbit product, feature or technology.”

Jawbone went out of business in the summer of 2017 but its spin-off, Jawbone Health, provided the following statement to The Verge:

“We believe the Justice Department’s indictment of six current and former Fitbit Inc. employees for stealing trade secrets from their former employer, Jawbone, validates the claims we made in our 2015 lawsuit against Fitbit.”

Frankly it sounds so moronic that it is very hard to believe. Cause it would mean fitbit has gone against the industry practices and even common sense to commit this stupidity which came back to haunt them now

This is about current and former Fitbit employees. It is nowhere stated that Fitbit used or benefited from this. Fitbit's statement confirms that. If Fitbit did benefit, no doubt Jawbone would have gone after them.

This is a ruling against these people in their private capacities, it seems.

Well, if the employees knew those secrets, (which they did because they worked for Jawbone), but didn't use them to benefit Fitbit, how would one expect to get rid of those nasty old memories floating around in their heads? It sounds like Jawbone is expecting a frontal lobotomy be performed on these individuals, as an NDA apparently isn't sufficient... :eek:

Personal experience needs to be separated from professional trade secrets. Personal experience in a specific field is what normally gets you hired. In no way am I saying that trade secrets should move across with you, but of course the new employer will leverage all they can to make the best of the knowledge and experience of the people they hire. It's a fine line, but its pretty normal across any industry.

Jawbone should have a data protection policy that their employees, current and former, should abide by. Same goes for any company. They should have systems in place to limit data leaving their organization.

You can't expect full performance from an employee, without full access to corporate systems. Depending on a worker's capacity for criminal behavior, I expect a micro SD card, could be passed and swallowed like a drug balloon.

I'd rather have a Bottle in front of me ,than a frontal lobotomy,:p

but seriously, you can not expect former employees to not use their xp and newly acquired knowledge to further their own careers, stolen hardware or code , say ,on a stolen laptop ,sure, but what they have learned ,and new skills, they own and can apply on a new posting, maybe should have paid the guy .the raise he was looking for.

AMD will be going after intel for what ever is in Raj koduri's head, he would be pretty useless to intel then wouldn't he? he must have had to sign an NDA with RTG before getting his severance package?AMD must be having a shitfit about now!
I learned lots in 30 + years in the trades ,that knowledge and xp is mine to do with as I please.
