Man sues Apple for "wiping his life" after store deletes years of data from his iPhone

Sue right , sue left, sue front, sue back , sue rich guy ,sue a rich company! I dont unferstand Westerners, what has your " priceless memries" pictures got to do with monetary gain and penalising the other party, not that it is insured. So "their "priceless" memries had got its prive? What a con job!

Any other company would probably do the same thing.

I work in IT. We are a dealer with HP. ANYTIME we send in a laptop for warranty repair we image the entire drive or at least back up the users profile.

However I would side with the customer on this one. If Apple took the phone they should have either a) Asked the customer if he/she backed up the device via iCloud/iTunes recently or b) Created a local backup of the device. You are in a profession in which others seek your help, act like you know what you are doing.

Doing what Apple did was basically telling the customer "We don't care about you or your data".

Correction: What Apple did was to ASSUME the customer read his email and followed instructions - - kinda like what we see PC users doing here all the time :sigh:

If the apple staff did not ask if he backed up his data before wiping the phone then its there fault no matter what. That is a question I always ask while I am inputting there info in the system in my shop. Then it is put in to the notes that I asked and his answer. The customer then has to sign that he is dropping it off and I asked him.

Its called CYA (Cover Your A**). Apple needs to train its employees better.

GOOD FOR YOU (y) Some people just know how and even protect the user from him/herself !

Now pay attention boyz & girlz, and children of all ages. This is what happened to Alice Cooper after Apple wiped his phone:

You could be next!

(I don't know about you, but I think they could have at least given him a complimentary Apple straight jacket, and maybe one for his lawyer).

When you buy the iphone doesn't it say on the warranty that you have to backup the device before submitting it to a check up/repair?

Well, I hate to be the bearer of bad news, but the age of stone tablets is pretty much behind us. We, as humans, have ignored their latent wisdom throughout the ages as well.

The computer, and allegedly the web, are making us smarter. Yet we're still unaware of how volatile those little 0's and 1's actually are. Over the years I've had my share of malware along with the attendant re-formats, but really haven't lost much in the way of data..

The responses to this article seem to be seeking an answer as to, 'who's right, and who's wrong", in this affair.

I'm going to go ahead and postulate, "two wrongs don't make anyone right. Nor do two imbeciles a genius make".

I have absolutely no idea what you are talking about....

I moved from facebook to techspot to avoid annoying people, turns out you guys are everywhere...
I'm incredulous of the fact your ability to reason abstractly, hasn't matured to the point where you can, (as the children say), "wrap your head around my post". (#35 above, so we're clear).

Your post was clear. The relevance of it to my post is not clear. But I can see you are the type of person that always want to be right and for some reason trying to sound smarter than others (last time I saw someone using the word "incredulous" was in the bible) so enjoy it...

Wow, I pulled "incredulous" out of thin air.... , haven't even read the bible in at least 50 years. (They burn my skin).

Well, there does at least exist the possibility I am smarter than some people..

Let's see now, you're the one who came in on the attack sic, "I have absolutely no idea what you are talking about...."

Guess what? There was no actual need for you to understand it. You first post to the thread, (possibly to the website). added no content to the topic. It was simply an ad hominem attack, based on your own inability to understand my points of reference.

And now, you're passing yourself off as an amateur psychologist. We can go around in circles ad infinitum about your off topic nonsense, or your desire to have the last word by claiming you don't want it. (Basically, "that's the end of this discussion because I said so"). But the reality is, the solution to the issue is based in folk wisdom, not in pop psychology. On internet trolls and trolling, it boils down to this, "it takes one to know one"... :p

Wow, what a stupid discussion @captaincranky @JeromeFree
@captaincranky - now I understand how you got almost 12k posts....
Well, I sure am glad you stopped by to straighten us out (*). Your insight was long overdue. Quite unwelcome, but overdue. (Not really).

Did you have anything to add to the topic, or is this just a drive by personal attack? No? I didn't think so.

All this time I had been thinking I had 12K posts by virtue of the fact I've been a member here for over 9 years.

Are you some other clown who got diverted here from Facebook? Maybe your interests would be better and more easily served by picking a fight with just Jerome.....

And Tim, you're my favorite one post wonder in the whole world. (I'm a pathological liar among all my other faults)..:D

(*) Just kidding...:p

hehe, love ya man :)

Hey, don't sweat it!

I'm pretty sure that the NSA has a backup.
Yeah but, those humps have their own "private cloud", and I'm pretty sure they're not up for sharing it with you.....:(

Unless of course, you can get China to hack it for you......;)

(Just kidding up there, if you're listening.... ).

I believe that apple have a nack of doing what they think is best. a Swedish legal firm had iphones issued to all their staff & they had a custom app installed on all their phones with encryption for security of all matters & so forth. Apple did its usual OS update & detected this app wasn't verified or authorised by apple, which it doesn't have to be mind you. So apple automatically wiped all the phones to a factory reset state. The firm lost important info, data & contacts & sue'd apple & won £1,8 million in damages as Apple had no legal right to delete an app they don't own, wipe data they don't own & force a factory reset of the device without the user's consent!

It was in the news a while ago!
