Valorant developer Riot will begin recording player voice chat to combat harassment

An TOS meaningless when talking about children and you should know this. It's not illegal to ban someone because they broke the TOS, but it is illegal to use the TOS to do something illegal even if the child "agreed" to it.
If you read the TOS most are specific enough that they actually require an adult to acknowledge them on behalf of the minor child. Most children that are using the services without the approval of an adult are violating the TOS. This is why you don't see many privacy lawsuits against these companies with respect to children, the one's you do see don't succeed unless information was provided to third parties.

Can you please explain what is illegal on this situation? If you mean the fact that they can verify the content of the conversations you're having using their channel then it wouldn't be the same to say that Techspot doesn't have the right to have a mod that can delete comments or warn people about the way they are using their chat?
 
it's not a "public" chat, it's a team chat, only 5 people can access it. and even so, you need permission to record from a parent or guardian.
Isn't the fact that is open to the public even though is limited to 5 people playing on that team that makes it a public chat?

Completely irrelevant comparison. One is about recording and listening to children's conversations without the permission of a parent/guardian, the other is about comments available to anyone who visits a website.

Can you access the voice chat if you aren't part of that specific 5 man group? During, before and after the game? No.

Completely relevant in fact, unless that game is only targeted to people under 18 and no adults can play then in that case every conversation would have children in it, that's not the case and there's some legalities that you're supposed to agree to before using the software so it's the same and remember that Valorant is a PEGI 16 game so it's supposed to have only 16+ age people playing it unless you illegaly gave it to your less than 16 child.

I cannot access the voice chat at that time but I can open one every time I want and anyone can do it, is it closed while I'm using it? yes but not private, is like saying that public bathrooms are in fact private because you can only have one people at a time using it.

What does the PEGI rating of the game have to do with anything? And no it's not a public chat, it's a 5 way live chat and any recording of a child without the consent of it's guardians is not legal, at least where I live, so stop looking for excuses. Hell, you are not allowed to record without consent even adults, a TOS does not circumvent all laws and obligations.

You are confusing live chat with a recording, two entirely different things. A recording of a child in the wrong hands can have dire consequences. Unlike other shooters Valorant does allow children to play.

The only solution I see would be a system that uses AI and does not leave behind accessible records by humans.

So you really think that's illegal? Then try and sue Sony or Riot over that and let's see how it goes, I'm just saying.

is that supposed to be an argument? I don't need to sue anyone, I'm just finding it hard to understand why someone would try to defend such a thing act. what do you gain from doing so?

I'm not defending it, that's probably the issue on this conversation, I'm just stating a fact, is not illegal for them to do what they are going to do and what other companies are already doing, the only way to not get involved is not using any of the products they offer or in this case the voice chat, simple as that.

Let's take Sony for example since they also went through this with the 8.0 update. The voice recording they do is local, it means that it only leaves the consoles when the users report, edit it and sends it to Sony. All of the Valorant recordings will all be stored in the cloud for an unspecified period of time.

There is a reason why Riot is only starting with NA. They are afraid of EU laws.
