But instead they've made a fair portion of the hacking community angry at them. Nintendo needed to take the high ground, shut the offender down and prevent them from restarting. Instead they screwed the guy over with prison time and imposed a debt he'll never recover from.

If the hacking community go after Nintendo, then unless they are reporting vulnerabilities for bounties rewards, then they too will be rightfully dragged through the courts if caught.

This isn't 'tha haxx0rs wil get um!' That's not how it works. And almost all the actual hackers are in it either for criminally getting money or work for state actors.

As for Bowser? He wasn't some hobby hacker just messing about and trying to share some enjoyment. He was selling the ability to use stolen property. He knew exactly what he was doing.
 
40 months for $65M in theft? That doesn't sound all that bad. What's the standard for days per dollar? Hell, I have a family member who stole less than $10K from a bank and got 3 years in a Fed Pen.
It would depend how the money was stolen. This wasn't physical theft but enabling people to avoid paying for games. I'm not sure of how your family member stole the money from the bank. If he just failed to pay back an overdraft then 3 years is crazy. If he walked into a bank with a gun it might be too little.

Well, it's loss of revenue, to me that's theft. If your boss said he wasn't paying you for last week, isn't that theft? He didn't take money from you, just didn't pay you for your work. In this case, one guy helped others not pay for work done.

No guns in the bank robbery, but money was taken from the bank against their wishes.
