In France, when you buy something online, I.e. not in a store, you have 14 days to return it, no questions asked, provided the item is unused. This applies to *all* online/mail orders. That's the law here.

its honestly how ebay runs. you can put no returns all day on your item you are selling, but in the end as a seller u have to allow returns. its ebay stupid policy. it doesnt matter if the item is perfect or even if the buyer bought the wrong item. you have to take the return. garbage in my book.

does depend on the games you play, but my 2070 gets me 400 frames in valorant and csgo. and thats mostly what I play.

In the EU (not only in Germany) law *protects* the consumer and allows it to return, the law wasn't meant to scr.w scalpers. So it is not a regulation issue. If people don't want to help scalpers they can just not buy the inflated price devices....

I don't know how it is outside the EU, but inside the EU:
- you resell: you have to accept returns;
- you sell as second hand "as new": you don't have to accept returns;
- you are a person who buys a super inflated priced gpu just to play games: ... that person can figure it out...

If they buy several GPUs in short time the Seller could claim, that the Buyer is a commercial Reseller and thereby the so called "Fernabsatzgeschäft" (Remote Sales Law), which forces them to refund the GPU, isn't applying to the Buyer. The questions is if there is enough evidence so that the judge will rule in favor of the seller.

does depend on the games you play, but my 2070 gets me 400 frames in valorant and csgo. and thats mostly what I play.

Even @3440 with a 2008 i7 920@3.8Ghz in 54 games including RDR2,AC Valhalla, RAGE 2, Far Cry New Dawn@Ultra settings on all my 1080Ti averaged 55FPS. With my i7 7800X@4.6Ghz same res/settings with 1080Ti I got 62FPS average. 1080Ti is still good enough.

This is misleading and very much it NOT stopping scalpers from returning their cards if they choose as newegg policy (even for "replacement only" items) is to still provide a full refund as long as the item is still new in box... We know scalpers aren't going to be opening them so they have now thru February to decide what to do with them and can get a full refund at any point between now and then....

I know this (as did MLID who likley just didn't mention it to make his post for clout go further) because I have personally returned many replacement only products over the years to newegg for full refund without issue.

Even as recently as last month with a 4090 launch day card I ended up not needing after I got my 4090 FE from best buy....

Replacement only yet sent back and got my full refund no problem!

Except their not as I'm sure they like most who have shipped with newegg for along time know (and can read a policy) they will in fact take back even "replacement only" items for a full refund as long as said item is still new in box.... And what all of these people cheering on this "win" are ignoring or ignorant to is newegg policy actually states as long as item is still new in box even a "replacement only" item can be returned for a full refund... I would know returned my launch day 4090 that was listed replacement only for a full refund 10 days later once I got my hands on a 4090 FE.... 8 knew the policy applied and hence why I didn't open the 4090 for 10 days.
. Scalpers know this too and they aren't sweating it they have still 2 months to decide what to do and can get a full refund at anytime between then.

Usually these are consumer protections and a retailer can well argue that the scalper was not a consumer but acting like a reseller. Not sure if the law would apply in that instance.
