Scalpers are struggling to sell the RTX 4080 above MSRP, but retailers won't let them...

That's quite an anecdote you got there. Most blue collar dudes I know barely know about PCs let alone know enough to scalp GPUs on ebay.
50% are 30-49 ys old.

(Statista)
When it comes to the average PC gamer age in America, it doesn’t change a lot from the rest of the West.

  • Age 18-19: 6%
  • Age 20-29: 22%
  • Age 30-39: 31%
  • Age 40-49: 19%
  • Age 50-59: 14%
  • Age 60-64: 8%
As you can see, the biggest group are gamers aged between 30 and 39, closely followed by the 20-29 and 40-49 age groups. The most interesting fact to us is the number of gamers in the last age category, showing that older generations hold a noticeable gaming share.

can't find exact by income but this is a good summary
Based on video game demographics statistics from various sources, most video game players tend to fall within the lower-income range. However, committed mobile game players tend to have a mid-range household income. Data also shows that those who have a college or associate degree tend to spend the most time playing games.

22. Only 9.1% of People Making Between $125,000 and $164, 000 Buy Video Games.
Oddly, the people that you would expect to be able to afford more video games don’t spend their money on video games as much as those at lower income levels.

The income level that tends to spend the most on video games and accessories is between $67,000 and $76,000, at 13.5%. Following closely behind is the income group of $42,000 and below, at 13.2%.

To be fair, they're only following amazon's huge lead here by allowing nearly universal 30-day returns (and over Christmas up to 4 months)

if you bought a 4090 on launch day, you would still have two months to return it
In France, when you buy something online, I.e. not in a store, you have 14 days to return it, no questions asked, provided the item is unused. This applies to *all* online/mail orders. That's the law here.

"Unfortunately, the legal situation in Germany definitely prevents retailers from excluding returns."

Gov regulation creating problems? Who would have thought this could happen...
its honestly how ebay runs. you can put no returns all day on your item you are selling, but in the end as a seller u have to allow returns. its ebay stupid policy. it doesnt matter if the item is perfect or even if the buyer bought the wrong item. you have to take the return. garbage in my book.

In the EU (not only in Germany) law *protects* the consumer and allows it to return, the law wasn't meant to scr.w scalpers. So it is not a regulation issue. If people don't want to help scalpers they can just not buy the inflated price devices....

I don't know how it is outside the EU, but inside the EU:
- you resell: you have to accept returns;
- you sell as second hand "as new": you don't have to accept returns;
- you are a person who buys a super inflated priced gpu just to play games: ... that person can figure it out...

If they buy several GPUs in short time the Seller could claim, that the Buyer is a commercial Reseller and thereby the so called "Fernabsatzgeschäft" (Remote Sales Law), which forces them to refund the GPU, isn't applying to the Buyer. The questions is if there is enough evidence so that the judge will rule in favor of the seller.

does depend on the games you play, but my 2070 gets me 400 frames in valorant and csgo. and thats mostly what I play.
Even @3440 with a 2008 i7 920@3.8Ghz in 54 games including RDR2,AC Valhalla, RAGE 2, Far Cry New Dawn@Ultra settings on all my 1080Ti averaged 55FPS. With my i7 7800X@4.6Ghz same res/settings with 1080Ti I got 62FPS average. 1080Ti is still good enough.

This is misleading and very much it NOT stopping scalpers from returning their cards if they choose as newegg policy (even for "replacement only" items) is to still provide a full refund as long as the item is still new in box... We know scalpers aren't going to be opening them so they have now thru February to decide what to do with them and can get a full refund at any point between now and then....

I know this (as did MLID who likley just didn't mention it to make his post for clout go further) because I have personally returned many replacement only products over the years to newegg for full refund without issue.

Even as recently as last month with a 4090 launch day card I ended up not needing after I got my 4090 FE from best buy....

Replacement only yet sent back and got my full refund no problem!

With what's going on in America this made my day ha ha.

See my post above this does zero to stop them if they want a full refund they can get it now til Feb.

Been waiting for this for a while now, what can I say better than this little guy here:

InfamousSnivelingBobcat-max-1mb.gif
Yea sorry but this is meaningless... They can still get a full refund as long as the card isn't opened see my longer post above.

Do you hear this sound, scalpers dear? Yeah: it's the smallest violin in the world singing. For you. Please enjoy :-D

Hate to burst your bubble but see my post above... It's not stopping them whatsoever they will still get full refund if they choose now through February.

Newegg Customer Service: Thank you for contacting customer service, how can I assist you?

Scalper: I want return some merchandise under the invoice number I sent you.

NCS: Could I inquire what the return is for, as I pull your order up?

Scalper: I don't need anything on this order. I just want to return them.

NCS: I see you have 8 RTX 4080 cards on this order. I have to inform you that we are not accepting returns on these cards. I'm sorry, but I can not assist you on a return.

Scalper: But I don't need any of them! I want to return them for a refund!

NCS:

Yea sorry not how this actually works see my post above but they absolutey can still get a refund no questions asked and thru February too... They aren't sweating this piece of copium from gamers favorite (mis)leader.

Any time I see scalper hosed, it's a good day!

Except their not as I'm sure they like most who have shipped with newegg for along time know (and can read a policy) they will in fact take back even "replacement only" items for a full refund as long as said item is still new in box.... Scalpers only aim to sell "new" cards so they ain't opening them and hence can get a refund now thru February (thanks to holiday return period)

This was just MLID misleading once again and trying to get some gamer clout from the copium.

Let scalpers and miners together burn in hell!!!!!

This doesn't effect them at all see my post above but they can still absolutey get a full refund no problems as newegg always takes back new in box items even when listed as "replacement only" I would know I've had to do it many time over the years.

They are likley reading these pieces and laughing knowing they can sit on them til February and still get all their money back no problem

To be fair, they're only following amazon's huge lead here by allowing nearly universal 30-day returns (and over Christmas up to 4 months)

if you bought a 4090 on launch day, you would still have two months to return it

And what all of these people cheering on this "win" are ignoring or ignorant to is newegg policy actually states as long as item is still new in box even a "replacement only" item can be returned for a full refund... I would know returned my launch day 4090 that was listed replacement only for a full refund 10 days later once I got my hands on a 4090 FE.... 8 knew the policy applied and hence why I didn't open the 4090 for 10 days.
. Scalpers know this too and they aren't sweating it they have still 2 months to decide what to do and can get a full refund at anytime between then.

Mine ain't breaking, I'm tremendously happy they're losing money 😊please don't get anything from scalpers

Yea unfortunately they're not they can absolutey still return for full refund and have til February to do so... See my post above.

It's an EU consumer protection law, so it applies for all of EU.

Upgrading at this point has become pointless; even a 1080ti from years ago can give good enough performance.
Well, ya, cuz us gamers have backlogs that are filled with games that are twice as many years old! I should know, I'm one of them!

Usually these are consumer protections and a retailer can well argue that the scalper was not a consumer but acting like a reseller. Not sure if the law would apply in that instance.
