Tech industry braces as Trump announces new $100,000 H-1B visa fee

A hot potato: President Trump's administration has introduced major changes to the United States' high-skilled immigration system, unveiling plans to impose a $100,000 fee on new H-1B visa applicants and to offer a $1 million "gold card" investor visa that provides a pathway to citizenship. The measures, enacted by presidential proclamation, have triggered immediate backlash from legal experts, technology executives, immigrant advocacy groups, and foreign governments, who question their legality and warn of far-reaching consequences for the American tech workforce and broader economy.

The newly announced policy faces an uncertain future – not only in the courts but also in terms of international response and practical implementation. As stakeholders across multiple sectors brace for the fallout, the coming months will determine whether the administration's sweeping overhaul will take hold or face legal reversal.

Under the directive, the application fee for H-1B visas – the primary pathway for employing foreign professionals in highly skilled sectors – will rise from $215 to $100,000 for new applicants.

The administration clarified that the charge is a one-time fee, not an annual payment as some outlets initially reported, and that it will not apply to renewals or current H-1B holders. The new fee structure is expected to take effect with the upcoming lottery cycle and will not impact those holding visas from the 2025 lottery.

Technology and financial companies, which heavily rely on H-1B visas to fill roles requiring specialized knowledge, are likely to feel the impact most acutely. Many of these workers are recruited from countries such as India and China.

Amazon, the largest recent recipient of H-1B visas, employed more than 14,000 visa holders as of June 2025. Microsoft, Meta, Apple, and Google each reported over 4,000 H-1B employees during the same period.

The government's stated rationale is to discourage abuse of the system while prioritizing American workers. Still, the magnitude of the fee hike represents an unprecedented barrier for both employers and prospective immigrants.

In a parallel move, Trump also announced a new "gold card" visa, offering investors a path to US citizenship for $1 million, subject to vetting. For corporate sponsorships, the cost rises to $2 million per worker. In addition, the administration introduced the "Trump Platinum Card," priced at $5 million, which would allow recipients to stay in the US for up to 270 days per year without being taxed on non-U.S. income.

These new visa categories would replace several existing employment-based immigrant visa programs and require congressional approval for full implementation.

The announcements sent shockwaves through the country's largest technology employers. Many companies issued internal communications advising staff and contractors to remain in the US and to avoid international travel.

Amazon's immigration team, for example, urged H-1B and H-4 visa holders to return to the US before the changes take effect. JP Morgan Chase, Goldman Sachs, and Microsoft issued similar guidance, warning employees that traveling abroad could jeopardize their immigration status under the new policy.

Foreign governments are also scrambling to assess the implications for their workers and businesses. India's Ministry of External Affairs acknowledged the shared economic stakes for both Indian and American industries but warned of serious humanitarian consequences as families face uncertainty and potential disruption.

South Korea's foreign ministry reported that it, too, was evaluating the impact on its workers and corporate interests with operations in the US.

Legal challenges are widely anticipated, with critics contending that the president is overstepping Congress in unilaterally revamping visa policies. Doug Rand, a former senior official at US Citizenship and Immigration Services, told The Associated Press that the measures were "ludicrously lawless," arguing that they amount to little more than headline-grabbing fan service for immigration opponents. Labor organizations, such as the AFL-CIO, argue that the current lottery system should be replaced with awarding visas to the highest-paying employers – a policy Trump previously proposed during his first term.

The H-1B system has often come under scrutiny for being misused to fill entry-level positions rather than specialized ones, and for allowing firms to undercut US salaries by classifying jobs at the lowest wage tiers.

Consulting companies based in both India and the US have been prominent in using the visa program to contract workers to American employers, with the most recent data indicating a nearly 40 percent drop in lottery applications in 2024 after reforms aimed at preventing multiple, duplicate entries by prospective applicants.

US companies will still employ them just possible outside the country? what can not be moved outside the country is the 10,000 international medical residents on H-1B visas in the U.S., filling about 10,000 of 43,000 total residency positions, as of September 2025. There is also a possible up to 65,000 to 85,000 visas available for nurses. As of 2022, there were around 500,000 immigrant nurses in the U.S.
America is about to kill even more of their hospitals. I hope you all are ready to take care of yourselves. This is dumb af.
 
This is fantastic news. The H1B system has long been abused by the tech industry to cut wages and threaten employees, its not even an open secret at this point, it's a meme that companies create impossible job postings or turn down every applicant so they can excuse using the H1B system instead.

Predictably leftists are already upset that they can no longer underpay brown people and will have to invest in the country they want to wring dry of money to fill their own pockets.
 
Good, although I would have preferred getting rid of H1B entirely. We have other, far more stringent visa programs for people of actual unique talent as opposed to today’s H1B which imports, by the hundreds of thousands PER YEAR, people gunning for entry and mid level IT and engineering jobs). Even an annual fee of $100k instead of a one-time fee would be better because if this talent is so necessary (again, it isn’t) then employers should have no problem paying it. I’ve never understood the point of allowing big corporations to take up valuable space in this country, draining resources, and straining our infrastructure if they’re just going to bleed Americans out of the job market anyways.

Both sides of the Uniparty love big business and want to make things as easy for them as possible, damn the population of worker peasants that get hurt in the process. Trump is a populist and can somewhat still read the room, hence this move, but he's still a business guy and is unwilling to go for the jugular and actually rip the system out completely.

Eh, the EO (and the BBB that actually has the underlying law) allow the Executive to exempt specific companies, so it's just more grift. Expect companies that donate to the "Presidential Library", TPUSA, attend million dollar plate dinners, whatever to "magically" get exemptions.

Teams/remote work has already made the H1B less valuable than before. Cheaper for multinationals to just set up shop overseas, pay people local wages, and then transmit code/research data back and forth than necessarily bring people here.

Also, I am VERY curious to know what happens to that $100K if companies/health care systems do have to pay it. It's going to be used to bolster training for Americans to do the same jobs right? Right?

Bill Clinton was the last president to end a fiscal year with a budget surplus (1998-2001). The last president to do that before him was LBJ(1969).
Learning history, I realized that more often than not, most of the outcomes of a president are delayed.
And quite often, the one who got into the office would take the credit for work previous president did.
it applies to many areas including management and business. Some people are not recognized for great things but they should be.

Plus Gingrich was the speaker of the house we know as the purse. He doesn't get enough Credit for balancing the last budget Historically speaking.

We do have the people to fill those jobs lots of people to fill those jobs. I know plenty of people in the IT sector that are in their '50s or early '60s that can't find jobs anymore they got laid off and the positions are being filled by H-1B workers working for significantly less.

We can fill all these positions it's actually rather easy we tell the department of education stop issuing student loans for education that doesn't benefit the US economy instead of going in for African American studies do you want student aid you're going into nursing, this is all very simple let's stop wasting our money on stuff we don't need and if people want to get these uses degrees let them pay for it and limit federal student aid to what's actually needed in the job market.

Anybody that thinks this is a bad idea is simply pro more unemployed Americans that's what the spoils down to. I'm completely fine with this plan.

If there were enough of high level technical workers in the US, no company would bother themselves getting workforce from overseas.
If not for the underpaid education system, there wouldn't be lack of technical workforce.
It's a myth companies take people from overseas so they can save money on cheap workforce. There are a lot of position open, but there is no enough educated people to get them. And from those who get some education in the area, many are unreliable and simply bad at the job.
But sure, you don't need them. You will rather fix your education system so you can train more specialists. So all the other... can work in India, China, eu. How gracious.
Yet, if you actually get only us people, and paid then triple the amount what you think is underpaid, who will be able to buy this product or services? Or, who actually would buy them, if they can buy cheaper from Asia? Sure, you can put tariff on goods going to US, because it's you who is paying the higher price, but to sell them for this crazy monies... How?
Trump and his friends will be fine. It will become paradise for super rich. All taxes paid only by poor. Large numbers of poor people. Oligarchy is already a fact, unfortunately.

Such a terrible take. I was laid off with the rest of my team by an it services company that brought in H1B workers to do your job for $8 less an hour. They told us they were there to help us and wanted us to train them. The people were friendly enough to tell us that they were happy to be getting into it and getting to have the American dream. They also told us how much they were getting paid.

3 weeks later all of us were laid off and also the IT staffing company could probably make an extra 100 grand. I filed a complaint and then I found out the finest so small that it doesn't matter.

Don't tell me there's not people here to do the work there is but the fine has been so small and enforcement so lacks that it's seen as worth the risk.

We need to not only do this but we need to also impose a 75% tax on anybody living outside the United States receiving a paycheck from a US company we just need to make that part of the tax system for that.
